A federal court on Sunday issued a temporary restraining order blocking the Trump administration from sending three Venezuelan immigrants held in New Mexico to the Guantánamo Bay, Cuba, detention camp as part of the president's efforts to remove illegal immigrants from the U.S.

Lawyers for the trio said in a legal filing that the detainees "fit the profile of those the administration has prioritized for detention in Guantánamo, i.e. Venezuelan men detained in the El Paso area with (false) charges of connections with the Tren de Aragua gang."

In the filing, the lawyers asked a U.S. District Court in New Mexico for a temporary restraining order to block the administration from flying them to the U.S. military base. The lawyers noted that "the mere uncertainty the government has created surrounding the availability of legal process and counsel access is sufficient to authorize the modest injunction."

Judge Kenneth J. Gonzales granted the temporary restraining order, according to attorney Jessica Vosburgh, who represents the three men.

"It's short term. This will get revisited and further fleshed out in the weeks to come," Vosburgh told The Associated Press.

The filing came as part of a lawsuit on behalf of the three men filed by the Center for Constitutional Rights, the American Civil Liberties Union of New Mexico and Las Americas Immigrant Advisory Center.

Last week, Homeland Security Secretary Kristi Noem and White House press secretary Karoline Leavitt separately said that flights carrying detained illegal immigrants had been sent to Guantánamo.

Immigrant rights groups sent a letter on Friday demanding access to people who are now being held at the U.S. naval station, arguing that the base should not be used as a "legal black hole." Guantánamo has been criticized around the world for its inhumane abuse and torture of detainees, including interrogation tactics.

The immigrants are being held in the Guantánamo detention camp that was set up for detainees in the aftermath of 9/11. The immigrants are separated from the 15 detainees who were already there, including planners in the 2001 terrorist attack.

Trump has promised to expand the detention camp to hold up to 30,000 "criminal illegal aliens."

Leavitt said Wednesday that more than 8,000 immigrants have been arrested since Jan. 20 as part of Trump's plan to detain and deport immigrants in the country illegally, although hundreds of those arrested have since been released back into the U.S.

The attack 50 years ago today was aimed at the heart of American liberty. 

It targeted a place where our nation was forged during the revolution and where George Washington took his leave knowing the future of his new nation was secured.

On December 4, 1783, nine days after the British evacuated New York City, Washington held a banquet at Fraunces Tavern in lower Manhattan to bid farewell to his troops.

On January 24, 1975, the Puerto Rican separatist group, the FALN, planted a bomb that ripped through the historic site at lunchtime, killing four and wounding more than 50 others in lower Manhattan. Sixty-six-year-old banker Harold Sherburne, 28-year-old businessmen Alex Berger and 32-year-old James Gezork were killed.

"They were really attacking the American people," says Joe Connor, whose father, Frank, was a 33-year-old banker who was killed in the terrorist attack.

"They attacked Fraunces Tavern because that's where George Washington bade farewell to his officers after the Revolutionary War, where the Sons of Liberty met and was a symbol of American liberty and justice and freedom, and they couldn’t abide by that."

Joe was 9 years old the day his father was killed, and in the decades since, he has dedicated his life to bringing justice for his father and the other victims. He is the author of "Shattered Lives: Overcoming the Fraunces Tavern Terror," which is also now a documentary. Connor has, with other families, elected officials and law enforcement, waged a mission to hold the terrorists to account.

No one has ever been charged in the attack, but the man believed to be the terrorist group's chief bomb maker, Willie Morales, escaped to Cuba, where he has lived along with an estimated 50 other U.S. fugitives. A bill in Congress named for Joe's father and New Jersey State Trooper Werner Foerster, who was killed by Black Liberation Army militant Joanne Chesimard, aka Assata Shakur, who also is on the lam in Cuba, demands Havana return the fugitives.

"It's a very concise, clear bill demanding the return," says Connor. "There has been a mystique about the Castro regime and Che Guevara, of some fanciful romantic view of these people. But they were nothing but Marxist thugs and were waging their own war on the United States for many, many years."

In his final days in office, former President Joe Biden removed Cuba from the State Department list of State Sponsors of Terrorism.

President Donald Trump immediately put Havana back on the list, and in his first term also vowed to put pressure on Cuba to return Morales and the other fugitives.

During his U.S. Senate confirmation hearing, U.S. Secretary of State Marco Rubio called for Cuba to cough up the criminals who remain on the lam.

"There are fugitives of American justice, including cop killers and others who are actively hosted in Cuba and protected from the long arm of American justice by the Cuban regime. So, there is no doubt in my mind that they meet all the qualifications for being a state sponsor of terrorism," Rubio said.

Over the last two decades, FALN members have been granted clemency, as if the years that passed lessened their crimes. President Barack Obama commuted the 70-year sentence of Oscar Lopez Rivera, who was convicted of seditious conspiracy and charged with other crimes. President Bill Clinton offered clemency to the terrorist group's imprisoned members, which eleven accepted in 1999.

At a ceremony marking the bombing, New York City Police Commissioner Jessica Tisch said the bombing "was terrorism in its purest form, meant to frighten, intimidate, to injure, maim and kill in order to achieve their political purpose.

"For 50 years, no one has been held accountable for this attack, which remains an open investigation by the NYPD and the Joint Terrorism Taskforce," Tisch said. "Our department never forgets."

Before the ceremony marking the bombing, there was an emotional luncheon attended by family members, dozens of former FBI agents, survivors of the bombing and others.

Joe Connor's son, Frank, named for his grandfather and who is studying to be a priest, gave the benediction.

"We remember the four men who were killed 50 years ago today in this very place, and all of those whose lives were cut short by terrorism."

Joe noted how the gathering was being held by the door where the bomb, which consisted of ten pounds of dynamite, was placed inside an unassuming briefcase.

"Cuba has to eventually turn these people over, and the only way that will happen is by keeping them on the State Sponsor of Terrorism list and by keeping the pressure on Cuba," he says. "This is the moment to do it."

President Biden’s proclamation removing Cuba’s designation as a state sponsor of terror caused an uproar in Florida, notably among the president's fellow Democrats.

The rare political unity in the Sunshine State was pronounced after Biden certified on Tuesday that Havana's Miguel Diaz-Canel regime has "not provided any support for international terrorism" during the preceding six-month period.

Biden’s declaration also claimed Havana provided Washington with assurances it will not support terrorism in the future, and that the U.S. maintains its "core objective" of "more freedom and democracy" for the Cuban people.

However, Democratic Floridians were up in arms at the development.

Rep. Jared Moskowitz, in heavily-blue Broward County, told Axios on Tuesday that the outgoing president is doing lasting political damage.

"This is Joe Biden literally sinking the Democratic Party in the state of Florida," he said. "Big time."

Once the most notable "swing state" — rife with ballot "hanging chads" and the "Brooks Brothers Riot" of the 2000 election — Florida has seen a major rightward lurch in recent years.

State Gov. Ron DeSantis orchestrated an electoral blowout of Republican-turned-Democrat Charlie Crist in 2022, and President-elect Trump shocked the state by flipping Miami-Dade County red in 2024.

Trump lost Miami-Dade by 30 points in 2020, but won by 11 points in November. The county has a sizable Latino and specifically Cuban-American population — highlighted by its famed "Little Havana" neighborhood along U.S. Highway 41.

"Just as we try to patch the hole in the boat, Biden punches another hole in it," Moskowitz told the outlet. 

"Florida is a red state, and Biden just waved the white flag of surrender."

Meanwhile, Florida Democratic Party chair Nikki Fried said she is "disappointed" at the decision.

"We condemn in the strongest terms Cuba's removal from this list, as well as any possible lifting of economic sanctions, and call on the Biden Administration to reverse course immediately."

Fried said in a statement that generations of Floridian Cuban-Americans have shared stories of the Castro regime’s oppression, and that Diaz-Canel is Raul Castro’s "hand-picked successor" as the first non-Castro to lead Cuba since Fulgencio Batista was overthrown by the Castro brothers in 1959.

Following the terror-sponsored designation change, Havana officials reportedly pledged to release more than 500 political prisoners — for which the Catholic Church had been negotiating for some time.

As the news fell just ahead of Cuban-American Sen. Marco Rubio’s confirmation hearing to be Trump’s secretary of state, a spokesperson for Biden told Axios the timing is strictly coincidental.

Rubio is one of several lawmakers — and residents — of South Florida whose parents or grandparents fled the Communist nation.

Rep. Carlos Gimenez, R-Fla. — the only Cuban-born member of Congress — called Biden a "pathetic coward" for his decision to drop Cuba’s terror-sponsor designation.

Gimenez added that Rubio will "pulverize the [Castro/Diaz-Canel] regime once and for all."

He told Fox News Digital that Biden’s decision is "morally bankrupt" and geopolitically "treacherous," for a malign regime that sits less than 90 miles from the edge of his own congressional district’s Monroe County boundary.

Gimenez went on to warn that the decision ignores Cuba’s coziness with the Chinese Communist Party, and intelligence sharing with Venezuelan strongman Nicolas Maduro and Nicaraguan leader Daniel Ortega.  

"The [Cuban] dictatorship must be confronted and isolated — never appeased."

He praised Florida leaders from Biden’s side of the aisle for being willing to speak out at such an important time.

Rep. Mario Diaz-Balart, a Republican whose Miami-Dade district abuts Gimenez', said he is "disgusted but not surprised" by what he called Biden's "final acts of betrayal to the security interests of the United States."

As Moskowitz and other Democrats warn of the damage being done to the Democratic Party by moves such as the removal of Cuba’s terror-sponsor designation, several Florida Democrats have fled the party and praised Trump in recent weeks.

Maureen Porras, the vice-mayor of Doral, Florida — the tony Miami suburb where Trump owns a golf club and resort — told The Floridian her now-former party "prioritized minority opinions" and "neglected to… address the real issues affecting our community." 

Meanwhile, State Reps. Susan Valdes of Tampa and Hillary Cassel of Hallandale Beach, Florida, recently changed their affiliation from Democratic to Republican.

China is denying a new report linking it to four bases in Cuba that a think tank says allows the CCP to spy on the U.S. 

The Washington, D.C.-based Center for Strategic and International Studies (CSIS) released a report last week detailing facilities in Cuba that it claims China may be using to gather signal intelligence (SIGINT) on the U.S. 

"The cooperation between China and Cuba is aboveboard, not targeting any third party, and does not allow any malicious slander from third parties," Chinese foreign minister Mao Ning told reporters on Wednesday. 

Cuban foreign minister Carlos de Cossio claimed reports of Chinese spying hubs in Cuba originate from "Cuba’s enemies" in the U.S. "as a way of justifying the criminal policy of economic aggression. It is absolutely false."

CSIS analyzed over a dozen "sites of interest" in Cuba and four stuck out as most likely to be supporting China and its spying ambitions. 

"These sites have undergone observable upgrades in recent years, even as Cuba has faced increasingly dire economic prospects that have drawn it closer to China," the report's authors said. 

Each of the four sites had "observable SIGINT instrumentation," clear physical security infrastructure and other signs of intelligence collection. 

One such station located on a hill overlooking Havana, Bejucal, has been suspected of ties to Chinese intelligence for years. The complex gained notoriety for housing Soviet missiles during the Cuban missile crisis.

During the 2016 presidential debates, Sen. Marco Rubio, R-Fla., called on Cuba to "[kick] out this Chinese listening station in Bejucal."

According to CSIS findings, satellite imagery shows that the site was active as of March 2024 and had been for some time. There are at least five entrances to underground facilities at the base, but what the facilities contain could not be discerned by satellite imagery. Antennas dot the ground, including satellite antennas used for intercepting satellite communications. 

With Havana situated just 100 miles off the coast of Florida, the site could potentially be used to collect data on U.S. rocket launches from Kennedy Space Center and Cape Canaveral Space Force Station in Florida.

The U.S. and China are locked in a space race and rocket launches that deliver U.S. satellites to space will likely garner a high level of interest within the CCP. 

On another site on the opposite side of the island, east of the city of Santiago de Cuba, a large radio signal finding technology project is under construction, one capable of detecting signals between 3,000 and 8,000 nautical miles away. 

Cuba has a history of allowing U.S. adversaries to use its soil to snoop on U.S. communications. During the Cold War, the Soviet Union operated a SIGINT facility at the Lourdes Signals Intelligence Complex near Havana. That site monitored U.S. satellites and intercepted sensitive military and commercial telecommunications. 

In recent decades, the alliance between China and Cuba has grown – and China has provided around $7.8 billion in development financing to the island nation.
